These terms are the agreement between you and Spam Kathy ("we", "us") for use of the Spam Kathy call screening service. By signing up or using the service, you agree to them.
Spam Kathy answers inbound calls to a business phone line you designate. Kathy, an automated voice assistant, determines whether a caller appears to be a real customer or unwanted contact such as a robocall, telemarketer, or vendor solicitation. She passes real callers through to you and stops the rest.
Kathy answers inbound calls only. She does not place outbound calls of any kind.
You must be at least 18, operating a legitimate business, and authorized to make changes to the phone line you connect. If you are signing up on behalf of a company, you are confirming you have the authority to bind that company to these terms.
Keep your login credentials secure. You are responsible for what happens under your account. Tell us promptly if you think someone else has access.
Everything you tell us at signup should be accurate, including which phone system you use. We rely on it to set you up.
You are responsible for having the right to route and screen calls on the number you connect, and for your own compliance with the law in the places your callers are located. See our Call Recording Notice.
Nothing changes on your line until you take the setup steps we send you. You can reverse those steps at any time and your line returns to how it was.
Kathy will sometimes be wrong. She is software making a judgment about a stranger on a phone call in a few seconds. She will occasionally stop a call she should have passed, and occasionally pass one she should have stopped.
We build Kathy to err toward passing calls through when she is unsure, because we would rather send you a telemarketer than cost you a job. But we do not guarantee:
Any figures we publish about call volumes or spam rates describe what happened on a specific phone line at a specific time. They are not a prediction about yours. Any estimator or calculator on our website produces an estimate, not a measurement.
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent the law allows.
Spam Kathy is not a phone service and is not a substitute for one. It does not provide access to emergency services. Do not rely on it to reach 911 or any emergency line.

We can suspend or terminate an account that violates this section, without refund.
Fees, billing period, and what each plan includes are what we agree with you in writing at signup. Fees are billed in advance and are non-refundable except where these terms or the law say otherwise.
If we change our prices, we will give existing customers at least 30 days notice before the change applies to them.
If a payment fails, we may suspend the service until it is resolved. Your line reverts to normal when the service is suspended. It does not stop working.
You can cancel at any time. Your service continues until the end of the billing period you have already paid for. There is no contract term and no cancellation fee.
On cancellation, reverse the setup steps and your line returns exactly to how it was. We will keep your data for the periods described in our Privacy Policy, and you can ask us to delete it sooner.
We can terminate or suspend your account with 30 days notice, or immediately if you breach these terms. If we terminate without cause, we refund the unused portion of what you paid.
Your call recordings and transcripts belong to you. We hold them to provide the service and to improve it. We do not sell them. Our Privacy Policy and Call Recording Notice cover the detail.
Spam Kathy, the software, the name, and the branding are ours. Using the service does not give you any ownership of them. Feedback you send us is something we can use freely without owing you anything for it.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business, or lost opportunity, even if we were told they were possible.
Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the event giving rise to the claim.
This includes claims arising from a call Kathy screened that you believe she should have passed through. Section 5 explains why.
Some states do not allow certain limitations. Where that is the case, the limitations above apply to the maximum extent that state allows.
You agree to indemnify us against claims arising from your use of the service, your breach of these terms, or your failure to comply with law relating to your phone line or your callers.
Spam Kathy shares common ownership with Mr. Pool Leak Repair, a Dallas Fort Worth service business. Kathy was built and first tested on that company's phone line, which is the source of the call data we publish. We disclose this wherever we cite those figures.
We may update these terms. If a change is material, we will give customers at least 30 days notice by email. Continuing to use the service after that means you accept the new terms.
If we ever end up in a dispute, Texas law applies and it gets handled in the Texas courts. Signing up means you agree to that.
If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing something once does not waive our right to enforce it later. These terms, plus the Privacy Policy and Call Recording Notice, are the entire agreement between us. You may not assign them without our consent. We may assign them to a successor.
